Justice, mercy or revenge

Today’s news has been pretty much filled with items about the decision to allow Abdelbaset Ali al-Megrahi, the man jailed for blowing up a US airliner over Lockerbie in 1988, to go home to die. al-Megrahi is suffering from terminal cancer and, according to some reports at least, has about three months to live. It is probably unsurprising that this release has generated a lot of vox pop about what an “outrage” it is that he be allowed home to die. One of the terms of his release is that al-Megrahi dropped his series of appeals against his conviction, saving the UK taxpayer a large amount of money; however I can only assume that he still thinks he is innocent (or at least has a chance of being found innocent) but no longer had the will to fight this.

In the UK a life sentence doesn’t actually mean you are expected to die in jail. The criminal justice system is, in theory at least, based upon the principles of removing an offender from society as long as they present a danger to society, while providing correctional education to allow them to reintegrate to society upon release.

Equally, in the UK (and the US I am fairly sure) there are frequent cases where a prisoner is released from jail on compassionate grounds. There is nothing specifically unusual about this case.

The biggest difference here is that this is a person who has killed Americans. As a result, President Obama felt the urge to pressurise the “Scottish Government” (hmm) to change its mind about al-Megrahi’s release. President Obamba is not alone in this, almost every US politician has tried to convince the Scottish Justice Minister to change his mind. The UK radio and TV news is running headlines about how this has “all been ignored” – as if the requests of US politicians should carry some weight in this matter. I notice that previously the US government fell over itself to listen to pleas from UK politicians about the treatment of Gary McKinnon… Or not.

All this is only mildly interesting. I notice with more interest, and a lot of amusement, that the same parts of the British media objecting to this were crying for the release of the convicted Great Train Robber Ronnie Biggs. Obviously there are differences, Biggs is unrepentant, proud of his crime and white so the objections of Jack Mill‘s son went largely ignored.

Unusually for a missive from WhyDontYou Towers, I have no real opinion one way or another over the treatment and final disposal of al-Megrahi other than to wish there was some actual justice and consistency in the UK Criminal Justice system. Justice is not about revenge. Fair treatment includes compassion. Nothing that happens to al-Megrahi will bring back the dead or turn the clock back to before the murders. If justice is allowed to become revenge, then Al Qaeda can give up, we’ve destroyed western society ourselves. There can be no doubt that al-Megrahi showed his victims no compassion, but so what? Do two wrongs make a right? Does anyone honestly think al-Megrahi remains a danger to society? The news is showing traumatic footage of the night Pan Am Flight 103 went down – what can this do other than inflame people about the decision, which I think is at least consistent with the UK criminal justice policy.

As is always the case, the BBC is an example of the odd responses. There is the frequently wrong idea that those who are emotionally entangled can give a just and reasoned opinion – the BBC website has an entire page devoted to “Reaction – Lockerbie Bomber Set Free.” Show the effects of emotional involvement, the sister of a victim understandably says:

I don’t know how you show compassion to someone who has shown no remorse for what he has done and as Mr MacAskill praised the justice system and the investigation and the trial, how do you then show this person compassion? It’s just utterly despicable. I think he should have died in prison. Why should he be returned to Libya? That’s not what we were promised. We were always told he would serve out his full sentence in Scotland.

It is understandable, but wrong. I cant begin to imagine the suffering this person has undergone, but that is not grounds for a policy decision. This is why in the Dark Ages we moved away from blood feuds and instituted a system of courts and laws.  While she may not, yet, see it, the only way to show compassion is in situations like this. There is no compassion in being nice to nice people you like. Compassion involves doing what is right even when you dont want to.

The inherently evil David Cameron gives us a sign of the Criminal Justice system we can look forward to if the Tories come to power:

This man was convicted of murdering 270 people, he showed no compassion to them, they weren’t allowed to go home and die with their relatives in their own bed and I think this is a very bad decision

Ah, an eye for an eye eh? Does the body count matter? If he had killed just one, would he be objecting? Is the only reason to keep him in jail the fact that 270 families were torn apart rather than one or two? I suspect that if you are a grieving family member, the pain is not reduced simply because no one else died.

The Scottish Labour Leader has shown a tendency towards fluid politics that is characteristic of the Labour Party in general:

While one can have sympathy for the family of a gravely ill prisoner, on balance, our duty is to honour and respect the victims of Lockerbie and have compassion for them. The SNP’s handling of this case has let down Scotland

Yes, have compassion for the victims. Making someone suffer because not doing so would upset the families is not compassionate. It is pretty much a cowardly response.

Annoyingly for a committed Atheist, the Reverend Ian Galloway (Church of Scotland) says what is, IMHO, the right thing:

We are defined as a nation by how we treat those who have chosen to hurt us. Do we choose mercy even when they did not chose mercy? This was not about whether one man was guilty or innocent. Nor is it about whether he had a right to mercy but whether we as a nation, despite the continuing pain of many, are willing to be merciful. I understand the deep anger and grief that still grips the souls of the victims’ families and I respect their views, but to them, I would say justice is not lost in acting in mercy. Instead our deepest humanity is expressed for the better. To choose mercy is the tough choice and today our nation met that challenge.

Infuriatingly I cant help but agree with everything he has said here.

If you want to read some genuinely insane arguments on this matter have a look at the BBC “Have Your Say” Pages. Here the hatred really flows. The whole of Europe is called “Cowardly” because the Scottish National Party stood up to American pressure. The irony is amusing, if the ranting is disturbing.

It saddens me that people are still suffering to such an extent about this. Their suffering will not be changed by this persons release, nor would their suffering end if he had died in jail. That political figures in both countries are making so much capital out of this is an example of how craven politics really is. When I find myself agreeing wholeheartedly with a Church of Scotland Reverend, its time to lie down.

In the spirit of this xkcd comic, I’d like to file a bug report on that section of the British public that Had its Say to the BBC on the swine flu epidemic.

You could basically construct almost any one of these farts-in-email format by perming any 3 items from the following list:

  • It was deliberately created in a military lab to cull the world’s population
  • It is a just media hype to sell papers
  • It is just a pharmaceutical industry hype to sell tamiflu
  • It is an imaginary disease dreamt up by the same media liberals who insist that climate change is a real danger.
  • Treatment is a waste of their precious public money
  • It’s just “flu” and, therefore, completely insignificant
  • It is completely out of control. (It’s actually possible to find this idea in the same email as the idea above)
  • I demand immediate access to the (so far purely conceptual) vaccination
  • The (so far purely conceptual) vaccination is poisonous and I refuse to take it.
  • The government has invented the epidemic to distract us from….

This example is a representative classic, in its mixture of selfishness, poor grasp of the English language and anti-labour government ranting.

One for the scapegoating record book

I am kicking myself for not running an online gambling book on how long it would take to find a scapegoat for banking crisis. But then, less than a week would have seemed too short a time, so, as the bookmaker, I might have actually lost out on this one.

As T-W said yesterday, the UK immigration minister has stepped up to meet our government’s desire to get re-elected at any cost, by announcing a “clampdown” on immigration. This lurch towards shamelessness has been predictably attacked by the Tories – whose natural constituency is the HYS nutter and the Daily Mail reader – as not being tough enough (garbage) and stealing their policies (true)

Mr Grieve [the Tory equivalent to the immigration minister] said Labour were matching Tory policies on setting immigration limits. (from the BBC)

I have a picture of someone who finds that they have lost their housekeys and believes that beating the crap out of their next door neighbour will magically get them inside their own front door.

I.e Does not compute. This sort of thing bears about as much relation to reality as something dreamed up in an alcoholic stupor by someone who has had their frontal lobe removed.

In any case, (apart from the use of “immigrant” as if it means “black person”) the “immigration” that gets little England so irate is immigration from Eastern Europe, over which the UK government can have no control, under EC rules. So the only immigration that they can control involves a tiny number of people from the commonwealth countries and people seeking asylum.

The treatment of asylum-seekers is already a scandal. Is it possible that the government plans to make it even worse, so that people impoverished by the financial collapse will feel they’ve got their money’s worth?

Does anyone seriously believe that they are about to lose their job or their home because of “immigrants”, rather than because of the economic meltdown? Such people are clearly too stupid to walk and chew gum at the same time. How on earth do they manage to survive anyway?

As I write this, the unpleasant immigration minister is on the Politics Show saying that stronger immigration controls will lessen racism, indeed that it is the ethnic minority population that’s calling for it…..

Back to my conceptual online betting scheme. What are the odds that the minister would claim that tougher immigration controls would actually counter racism? (less than evens) What are the odds that this is true? Basically zero.

Have your hate

I suspect the Twat-O-Tron has been at work on the BBC’s Have Your Say (HYS) pages once more. One of todays “discussion” topics is Should immigration be cut because of the downturn? As you can imagine, this sort of thing really does bring the spiteful, uneducated, masses out of the dark, hate-filled world they normally hide in.

As always, a second-rate politician has found a topic they can grand-stand on, which appeals to the base instincts of the public:

The economic downturn will mean fewer people from outside the European Union are allowed to live and work in Britain, the UK Immigration Minister Phil Woolas has suggested.
Mr Woolas told the Times newspaper that in times of economic difficulty, racial stereotyping gets stronger so jobs should go primarily to those who live here.
He said when people were losing their jobs, immigration had become an extremely thorny issue.
Mr Woolas said the government would not allow the population to go up to 70 million.

I doubt more than a handful of people outside his constituency had heard of Mr Woolas before this, but he has achieved his goal. His “inspiring” comments have drawn quite a bit of attention to him.

Predictably, at the time of writing anyway, the weight of comments on HYS is in support of this madness. It seems that people have an arbitrary idea of what means someone is “British” enough to be here. On its own, this is bizarre enough but it seems there is a new version of logic available to these people. Each of these seem to fall into a theme.

The first is made up from people who are slightly misled:

UK Government must respond to the changing economic situation by making drastic cuts in the non EU workers coming to work and live in UK.With recession knocking on our doors resulting in job losses and increase in unemployment it will be folley to allow the immigration at the present level. Immigration must be restricted to needed skilled workers only. [By the miracle of irony, this comment was from “Mohan Lal Ramchandani, Westhoughton, United Kingdom”]

Non-EU migrant workers are, despite scare-mongering stories, few and far between in the UK. There are already regulations in place to restrict this migration to skilled workers, which is why the non-EU migrants tend to be in highly specialised professions (Doctors for example). Now, as with all things, the jobs are open to everyone – if British doctors are either unable to take the job, or unwilling to work at the market rate, then why on Odin’s Earth shouldn’t non-EU immigrants do the work?

Worryingly for non-xenophobic lunatics, the jobs lost in the recession are always certainly going to hit “British” workers before they hit migrants; the migrants are already paid peanuts. This will provide an arsenal of madness for the xenophobes and it is worrying that the Immigration Minister didn’t think before he spoke. Well done HM Government.

The next category is the weird, irrelevant, analogy:

Typo’s aside, this madness. I have been Cairo and it looked very different to that. However, even if “Phil” was 100% accurate it carries a huge so what. London is not Cairo. The differences are immense, even if UK councils have gone down the road of less and less frequent rubbish collection…

The inevitable empty rant also has its place:

I just cant express my anger at the way in which New Labour have allowed immigration to run riot over the last 11 years in only 500 words.

Basically, this is someone who is just plain angry. They don’t really have anything to say and there is no coherent argument. They just wanted to rant about leftwingers. Well done them. Oddly, and sadly for the tabloids, most immigrant workers don’t put pressure on the NHS. People who are earning less than minimum wage aren’t really in a position to take a few days off sick. People who are here, living 30 to a house, dont make a huge dent in the NHS dentistry budget. Yes, a small percentage do use the health service but most don’t. They cant afford to.

Well, this is odd. There are quite a few which have made this claim (or a variation thereof). It strikes me as odd, because Labour’s managed to get in power while a Conservative government held the seat. So, did Labour have a secret load of migrants to vote for them or is this just nonsense? Equally weird, migrants dont get to vote… Truly, the world of HYS is bizarre.

Staying with the madness we get this:

Erm, yes. That is what Keith Best is saying, If the employer can’t find some one from the EU he takes his business elsewhere and employs from outside the EU. It is a shame that (on HYS) British-loving seems to mean the same as idiot. This is a milder version where a poor sense of history has conspired to create the idiocy:

There isn’t really all that much I can say to that, other than no.

The comments continue to be a mix of racist, mad or just daft, although having just refreshed them I see there is some balance there now. The oddest part is that people are in favour of immigration laws (which will only affect non-EU migrants) because they want to reduce the number of EU migrants. It really is that stupid.

Worryingly (for the UK) it does show how stupid our electorate is, and how easily they can be misdirected by a slightly cunning politician. I really do think that democracy doesn’t work – most people are too thick.

Ironically, if we did institute a system where people who could barely read or write English were deported, we’d be stuck as most of them (using HYS as my non-scientific, non-representative sample) would have been born here…

No smugness here

Jonathon Freedland wrote about the hate email he’s been getting from Americans who tell him, in picturesque terms, that non-Yanks shouldn’t have opinions on the US election.

The counterblasts featured all the usual themes ….America had saved Europe’s “ass” twice before — and we would doubtless come bleating for help again when we inevitably sought rescue from the Muslim hordes imposing sharia law on London, Paris and Berlin. We can’t defend ourselves, of course, because we are limp-wristed “Euroweenies”, effeminate socialists whose own decline robs us of the right to say anything about the United States, which remains the greatest nation on earth. …….
One Bill07407 managed to capture the flavour of this virtual avalanche — including the curiously homoerotic undercurrent that runs through much rightwing American invective — with this effort: “If you want Comrade Obama we will gladly ship him over after he loses in a landslide. Meanwhile you can kiss my ass. I bet you would enjoy it faggot.” Equally reflective, this from bioguy777: “I love it! A pansy-ass limey Brit begs the US to do his bidding while his own country slips further towards total Islamic rule. We’re electing McCain, and the rest of the world can piss up a rope if they don’t like it. 1776, BITCH!(from the Guardian).

I am impressed by the sheer energy of this rhetoric. But a bit stung, on a patriotic basis. Surely, our own home-grown right wing nutters can’t achieve this level of ranting? This is a hard act to folllow. These comments manage to combine communism; homo-eroticism; islam and the bottom word. all . They are slightly lacking in the random-capitalisation and generous-use-of-exclamation-marks that normally distinguish such comments, but nobody’s perfect.

Bah, can the British product compete in this growing international market?

I was irresistibly drawn to the Daily Express by a front page I saw today which claimed that muslim fanatics were planning an attack on EastEnders (a British soap) I fought back the thought “Finally, a use for Al Qaeda.”

The Daily Express. Surely, if there’s a serious national challenge to foreign rabid-ranting supremacy, it must be in the Daily Express? The Express has a website. Imagine my delight to find it even has a Have Your Say page.

I would have to say the Express may be guilty of trying to juke the stats though. It may be trying to win an award from the twat-a-tron. It provides a list of questions that its readers might want to Have their Say about. These topics have obviously been cynically calculated to get comments by the shit-bucketload, applying a simple “Bull and red rag” principle.

Hah. I don’t even need to read the comments. The Express reporters might as well have written them at the same time they picked the topics. They know exactly what buttons to press to get that fear-filled little-England worldview spewed out to fill their empty webpages.

I spent a fair bit of time scanning the 99 “benefits scroungers” comments but you could tell their hearts weren’t in it (maybe with some secretly fearing they might end up in that category themselves, in a world recession, and are possibly suddenly realising that £60 a week would barely heat and light their homes, let alone feed them.)

Better entertainment from the “ex-soldiers” in schools thread. I become uncomfortably aware that not only do these people hate and fear children (no surprise) but they believe that Britain’s armed forces are staffed by the human equivalent of pitbull terriers, who, if ever let loose on schoolkids would terrorise and bully them into behaving. And they think this is a good thing.

Well, except for those who fear that gaining actual teaching skills would draw their psychopathic teeth.

The answer is no, how will they instill discipline,
they would not be alowed to punish the kids, they could not yell at them the same as a squadie, and off coarse they will need to go through collage or university to get thier teaching degrees or deplomas, by the time they have been through the system they will be just as PC as the present teachers, or will they go striaght into schools with out any degrees or deplomas, and we will have teaching on the cheap.

(How beautifully ironic that this educational expert has managed to come out of school without grasping the rudiments of spelling and punctuation.)

Or there are still some who feel that the troublesome rule of law will still hamstring the psychopaths.

It’s probably too much to hope that these people can’t breed. In which case, no wonder that the UK has been told off again by the united nations for making its kids miserable.

It’s also something of a pretty serious insult to the British forces. These nutters somehow assume that any serving soldier is basically a thug, who has has been brutalised through training.:

I don’t know anything about army training that I haven’t learned from watching Vietnam war films (Full Metal Jacket, etc) but I suspect they don’t either. It’s just that they misread the message about what happens when you brutalise young men into becoming disposable killers. They assumed it was a template, rather than a warning.

Quite by coincidence, I just saw the British National Party’s manifesto (I am buggered if I’m putting a link to that) and its central concerns seem to be the exact same “issues” that feature as topics on the Daily Express’s Have your Say. The BNP apparently plans to go after the Tories’ more rabid voters.

(Well, at least it would split the Tories’ vote, so I can see an upside. But generally, this shit just frames political debate in terms that are ever more rightwing. So, we see the Labour party fallling over itself to be tough on immigrants and scroungers.)

So, in your face, right-wing Yanks. Britain still has much more than its fair share of people after your own twisted hearts. (OK, the Brit ones don’t care about abortion and wouldn’t recognise a creationist theory if it bit them on the nose, and the American ones don’t seem to hate teenagers much, but they certainly seem to be brothers and sisters under the skin.)

The Irony, It burns…

Don’t you just love “Have Your Say“? What a wonderful place for those without any education, or any concept of the society they live in, to get burning issues off their chest without any fear of being punched in the face.

One of today’s topics is “Should witnesses have the right to anonymity” (link may be dead by the time you read this but it lives in the BBC archives). In a nutshell, the Law Lords upheld a long standing British legal tradition that says you have the right to face your accuser, and now the moaning-right want to abolish it. Ostensibly this is to allow people to give evidence without fear of criminal retribution (which, incidentally already happens and has happened for many, many years).

I think removing this right would be insane. It wouldn’t really help the police as they can already protect a witness under threat, but would allow people to lie without having to suffer the consequences. This is, IMHO, a very bad thing.

Anyway, on HYS there is a healthy mix of reactions. This is good as it means there are sane people out there. Ironically, the pro-anonymity argument seems to wrap itself up in contradictions…

Take this tirade against the law lords for their ruling:

The government is supposed to make the laws in this country, not a bunch of sad, senile old freaks. It’s patently obvious to anyone with an IQ greater than that of a prune that witnesses should be allowed anonymity, otherwise no one in their right mind would ever give evidence against criminal gangs. These idiots should not be allowed to make any more decisions of this kind.

Wow. The elected government (so often the brunt of right-wingers ire) is better a the law than the Law lords? Hmm. I disagree but that is not the issue. From this madness we get on to how the quality of the witness will be determined if the accussed can not challenge them:

Identity Cards Will Cure All That Ails You

Well, first off, thanks to Alun sending me the link to the monstrously funny site called “spEak You’re bRanes” and the simply amazing Twat O Tron, I no longer have the faintest idea if the garbage posted on the BBC website’s have your say section is even slightly real. Worryingly, I think that the gibberish there is actually posted by real people. I say real people, but now I am convinced they are actually employees of the Home Secretary posting nonsense in a thinly disguised attempt to change public opinion. I would hate to think that people this stupid would be able to use a computer well enough to access the internet.

One of today’s talking points is the prospect of introducing Identity Cards to this once free nation. Weirdly the BBC seems to have used the wrong tense with the title, but it is called “Is the government creating a ‘surveillance society’?” and, boy, has it generated some nonsense.

Take this wonder from “Joy Pattinson” (claiming to be from Switzerland, but that just makes me think it is the Twat o Tron):

I have no confidence in this “government” whatsoever! They are unelected, uncouth and incompetent. But I am for ID cards 100% but think they should include everybody over the age of 12 with so much knife crimes in the UK. ID cards are in focus in other European countries and they are not considered security states. But I prefer to live in on with security and less personal freedom than the other way around. ID card protect the honest and legitimates. Those protesting are suspect! Joy

What? Seriously this idiot is claiming that carrying ID cards will prevent knife crime. How, Zeus only knows. I honestly cant even work out where to begin with this bit of nonsense. And, as a point of note, the Labour Party were elected to power in the UK, it is down to the party to decide on the leader of the government.

“John from Wilts” also produces a strangely “Twat-0-Tron”-esque comment with:

Should I have an accident anywhere in Spain when the card is swiped it gives my doctors name my Consultorio (Surgery) and access to my medical records which would include any time spent in hospital and the treatment recieved. What fuss people make about ID cards here is entirely childish and petty.

Again we have another magical use for ID cards to save lives. Quite why some one from Wiltshire thinks a Spanish health service card is any use to them – or different from carrying your British NHS card – is beyond me. Does the NHS even have a system which would allow this?

Oddly, this wonderful life saving use of ID cards is not one they could be put to – so quite how John From Wilts thinks it is relevant is beyond me. Is this an opening shot in the inevitable mission creep ID cards are going to suffer from?

People who support ID cards have a list of things they think the ID card will protect them from. The fact that none of these match the government claims is ignored. Weirdly, the government itself seems unable to quantify what value ID cards will give to our society. What crimes in the (say) last 10 years would have been prevented by people carrying ID cards?

Still, despite this, there seem to be people capable of at least some higher brain functions who support ID cards.

This blog is dedicated to the dribble-spattered lunacy of BBC “Have Your Say” discussions. Part of me thinks that the right-wing “blogosphere” of America is encouraging its slow readers to get over to the BBC and add their ill-informed opinions… but another part of me fears that the sample is actually more representative… perhaps the majority of people in the world really are this awful and stupid. I tend to assume that most of the BBC comments that cause apoplectic rage fits are spoofs. (It’s wishful thinking, I know, but leave me some illusions.) However, if even 1 in 10 of these comments are legit, it makes you wonder how people can be that stupid and still manage to operate an email account.
